By accessing or using any part of our service, including but not limited to our mobile applications ("apps") and website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). These Terms are subject to change at any time without notice, and the updated version will be effective immediately upon posting. It is your responsibility to regularly check for updates.
Official Channels: You must access our service solely through our official apps and not through any third-party applications or websites. Unauthorized use of our API, including making API request outside of our official apps, is strictly prohibited and may result in legal actions.
Personal Use Only: The content available through our service is for personal language learning use only. You may not reproduce or distribute our content and/or use it for commercial or business purposes without our express written consent. Additionally, the content may not be used for software training or development, including machine learning algorithms, without our written consent.
Acceptable Use: You are expected to use our service within a reasonable volume that reflects actual study efforts. We reserve the right to adjust usage limits at any time without notice and to terminate or limit access for any user or IP address for any reason without prior notice.
License to Apps: You are granted a license to download and install our apps only on physical mobile devices you own and control. You may not run our apps on simulators, emulators, virtual machines, or remote servers. You may not use automated tools, scripts, bots, or software to interact with our apps in a manner that simulates human interaction. You may not incorporate any part of our apps inside other apps or software. You may not attempt to alter or modify the normal behavior of our apps, nor may you attempt to extract the source code or reverse engineer any part of our apps. Unauthorized use of our apps is strictly prohibited and may result in legal action.
No Warranty: Our Service is provided "as is" and "as available" with all faults, and without warranty of any kind. We expressly disclaim all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, availability, or quality of any content or service provided.
Content Liability: Given the AI-generated nature of some content, there is a chance that inaccurate, offensive, or explicit material may inadvertently appear. We are not liable for such content, but users are encouraged to report any inappropriate material via our in-app reporting feature. We do not guarantee immediate resolution of these reports.
Age and Legal Requirement: By using our service, you confirm that you meet the minimum age requirement and any other legal requirement set by your local laws for accessing service and content of this nature.
Information Accuracy: You agree to provide accurate, current, and complete information about yourself as prompted by our apps.
Credential Security: You agree to maintain the confidentiality of your password and other information related to the security of your account.
ReadMe HSK Trademarks: The ReadMe HSK name and logo, along with all related marks, graphics, and logos, are trademarks (registered or not) of ReadMe HSK. Access to our service does not grant you any rights to use these trademarks without our prior written consent.
User Reports and Suggestions: By submitting feedback, suggestions, or corrections, you waive any claims to the intellectual property of your submitted content and/or features, and all submitted content (implemented or not) shall become the intellectual property of ReadMe HSK.
Your use of our service is also governed by our Privacy Policy, which outlines our practices concerning the collection, use, and disclosure of user information. By using ReadMe HSK, you consent to the terms outlined in our Privacy Policy.
Indemnification: You agree to indemnify and hold harmless ReadMe HSK and all its owners and employees from any claims, damages, expenses, or liabilities arising from your use of our service.
Limitation of Liability: ReadMe HSK is offered as a free service to support Chinese language learning. We shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages or harm arising from the use of, or inability to use, our service.
Data Breach: ReadMe HSK shall not be held liable for any unauthorized access, breach, or theft (whether physical or electronic) of data stored on its servers.
Governing Law: These Terms shall be governed by and construed under the laws of the Republic of Indonesia, regardless of your country of origin or where you access our service.
Initial Dispute Resolution: If a dispute arises out of or relates to these Terms, before initiating any formal legal action, you agree first to contact us directly via email to seek dispute assistance. Please provide a comprehensive description of the issue and your proposed resolution. We aim to respond and seek a resolution within 30 days from receiving your communication.
Binding Arbitration: If we cannot resolve the dispute through direct communication, either you or ReadMe HSK may elect to have the final dispute resolved by binding arbitration under the Arbitration Law of the Republic of Indonesia. The arbitration shall be conducted in Indonesia, in the Indonesian language. An individual party must be personally present at this settlement conference, and an entity party must be present at this settlement conference through an employee with settlement authority, though both parties may bring counsel as well.
Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action-basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Resolution and Arbitration: You and ReadMe HSK agree that the following disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (1) any disputes seeking to enforce or protect, or concerning the validity of ReadMe HSK's intellectual property rights; (2) any dispute related to, or arising from, allegations of theft, piracy, or unauthorized use of ReadMe HSK's apps and service.
These Terms constitute the entire agreement between you and ReadMe HSK regarding the use of our service. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect. Non-enforcement of any right under these Terms does not constitute waiver. This agreement was originally written in English. To the extent any translated version of this agreement conflicts with the English version, the English version prevails.
